Motorbike Accident Claim

16 Jul

Driving a motorbike offers you freedom and is a thrilling experience but it can be dangerous as well, you can have severe and fatal accidents. This is because motorbikes do not have air bags or safety belts to cover or protect you from an injury.

There are various laws which one should adhere to while driving a motorbike that decide who is at fault in an accident. Some of the laws are as follows:

1) DUI – This is driving under the influence of any type of alcohol or drugs.
2) Speeding – If you are driving over the posted speed limit.
3) Helmet laws – You should not be driving a motorbike without helmet where law requires it.

By law, bikers should have third party insurance coverage which covers injuries to another driver or passenger or damage to any other property.

Have you been in a motorcycle accident? Do you know how to make an insurance claim? If you have been in an accident whether you are at fault or not, you can make an insurance claim for your damages and injuries. Serious bodily injury claims generally require hiring an attorney, however claims involving minor injuries and property damage can be made yourself.

If you are lucky enough to survive an accident then these are the steps that you need to follow assuming you are in a condition to do so yourself:

1) Seek medical treatment – Make sure to get treatment for injuries, if any.

2) Report the accident to the police – You are required to inform the police so that they can file a complaint which will help you process your claim with the insurance company.

3) Take photographs of the scene of accident – Take names and addresses of any witnesses and parties involved in the accident. Also write down the insurance information of the other party if you are not at fault. Make a note of the license plate, color and make of all vehicles involved.

4) Contact your insurance company to notify them of your claim and communicate with the person assigned to your case.

5) You are entitled to claim your medical expenses from the auto-insurance provider regardless of if you have separate medical insurance or not. Make sure you keep all the bills and the medical treatment history documents with you so that it becomes easier for you to claim these.

6) Determine your property damages – You are entitled to get your motorbike repaired or replaced depending on coverage provided by the insurance company.

7)Calculate total expenses – Add up all your expenses for medical treatments and property damages. If you had to undergo any medical treatment, you may also be entitled to make a claim for your pain and suffering.

Make sure to keep all the documents and bills related to your claim in a separate file so that it is easier for you to present any document when the insurance company asks for it. You can also claim for any loss that occurred to any of your family member or your friend during the accident.

If the person whom you had accident with does not stop or does not have insurance, you can still make a claim for your damages and injuries, but this time the claim needs to be dealt with motor insurer’s bureau. This is an organization that provides claim to hit and run cases as well as for uninsured drivers.

Filing for a motorbike accident claim can be difficult because most people think motorbike drivers drive harsh and in a speedy manner but if you follow the steps mentioned above you will make the best possible case with the insurance company. Insurance companies try to pay the minimum but you need to be strong enough to ask for all the claims. You may also be interested in a car accident claim or a car accident injury claim.
